Article 1 – Ownership of the Vehicle and Use<\/strong>
The vehicle remains at all times the full property of Carvago Car Rental. The renter does not acquire any ownership rights and may not sell, re-let or in any way transfer the vehicle. The vehicle may only be used in Cura\u00e7ao for private transportation. Commercial use, off-road use or export of the vehicle is strictly prohibited.<\/p>

Article 2 – Rental Period and Return<\/strong>
The rental period is strictly limited to the start and end date and time as agreed upon entering into the rental agreement. The vehicle must be returned in good condition on or before the agreed return date, including all accessories (such as keys, inspection card, tax card, proof of insurance, GPS, child seat). Extensions are possible only with prior written consent.<\/p>

Article 3 – Authorized Drivers<\/strong>
Only the renter and any co-drivers listed in the rental agreement may drive the vehicle. All drivers must meet the age and license requirements established by Carvago.<\/p>

Article 4 – Responsibilities of the Renter<\/strong>
The Renter agrees to drive the vehicle responsibly, comply with traffic regulations and use the vehicle safely. The renter is responsible for fuel consumption and for checking basic vehicle conditions (such as dashboard warnings). Improper use or negligence will void the insurance and result in full liability for all damages.<\/p>

Article 5 – Maintenance and Repairs<\/strong>
Regular maintenance and servicing are not required during the short rental period. Any problems with the vehicle must be reported to Carvago immediately. Unauthorized repairs are prohibited and are entirely at the risk and expense of the renter.<\/p>

Article 6 – Breakdown Assistance and Towing Services<\/strong>
Breakdown assistance is included for situations such as a flat tire or mechanical failure. The renter should contact Carvago for authorized service in such cases. Unauthorized towing or repairs will not be reimbursed. Costs resulting from improper use of the vehicle are the sole responsibility of the renter.<\/p>

Article 7 – Loss or Damage of Vehicle Documents<\/strong>
In case of loss or damage of the registration certificate or other official documents, a replacement fee of USD 40.00 or XCG 72.00 will be charged.<\/p>

Article 8 – Traffic Rules and Vehicle Security<\/strong>
The renter must obey all traffic rules and park the vehicle in safe and lawful parking areas. The renter is responsible for locking the vehicle and safely storing valuables. Carvago is not liable for loss or theft due to negligence.<\/p>

Article 9 – Prohibited Uses<\/strong>
The following uses are strictly prohibited and invalidate insurance coverage:<\/p>

  • Use by unauthorized drivers<\/li>
  • Exceeding the permitted speed<\/li>
  • Driving under the influence<\/li>
  • Use off-road or on unpaved roads<\/li>
  • Commercial transportation or participation in races<\/li>
  • Vehicle overload<\/li>
  • Smoking in the vehicle<\/li>
  • Leaving the keys in the ignition or leaving the vehicle unattended<\/li><\/ul>

    Violation of these provisions gives Carvago the right to immediately terminate the rental agreement and results in full liability of the hirer for all resulting expenses.<\/p>

    Article 10 – Insurance and Liability<\/strong>
    Carvago offers All-Risk Insurance. These limit the renter’s liability, subject to the deductible:<\/p>

    • Minimum deductible: USD 500.00<\/li>
    • If damages are denied due to an exclusion ground or other legal reason, the tenant is fully liable for all damages<\/li><\/ul>

      Coverage is void if the renter violates traffic regulations or the provisions of this agreement, or uses the vehicle improperly. Damage incurred in Christoffel Park<\/strong> or caused by unauthorized drivers is expressly excluded from coverage. <\/p>

      Article 11 – Accidents and Theft<\/strong>
      In the event of an accident, theft or vandalism, the following applies:<\/p>

      • Contact the police immediately (911\/917) and Forensys (+5999 9223).<\/li>
      • Also, report the incident to Carvago immediately and submit a signed claim form within 24 hours.<\/li>
      • Include a situation sketch, time\/location and any witnesses.<\/li><\/ul>

        Failure to follow this procedure invalidates insurance coverage .<\/strong><\/p>

        Article 12 – Lockout and Key Loss<\/strong>
        A fee of USD 50.00 will be charged for opening a vehicle when locked out (lockout). This is not covered by roadside assistance coverage. If the car keys are lost or damaged, a minimum fee of USD 350.00 will be charged.<\/p>

        Article 13 – Early Termination and Repossession<\/strong>
        Carvago may terminate the rental agreement at any time and repossess the vehicle if the renter violates this agreement or uses the vehicle improperly. In case of early termination due to the tenant’s actions, there is no right to a refund.<\/p>

        Article 14 – Terms of payment<\/strong>
        Full payment is due at the start of the rental period. If a third party defaults on payment, the renter remains fully responsible for payment. Late payment or complete failure to pay will result in legal fees and collection costs.<\/p>

        Article 15 – Applicable Law and Competent Court<\/strong>
